These Terms & Conditions ("Terms") govern your use of Sharepix ("we," "us," "our") mobile and web applications ("App" or "Service"). By installing, accessing, or using Sharepix, you agree to be bound by these Terms.

1. Definitions

"User," "you" means anyone using Sharepix.
"Album" means a collection of photos created and shared via Sharepix.
"Content" includes photos, metadata, comments, and any user-generated uploads.

2. License to Use

We grant you a limited, revocable, non-exclusive license to use Sharepix as permitted by these Terms. We retain all intellectual property rights. You may not copy, modify, distribute, or reverse-engineer the App without permission.

3. User Account & Contributions

Account signup is not mandatory for contributors.
Album creators and contributors must provide accurate metadata (e.g., name/email).
You are responsible for all activities under your account.

4. User-Generated Content (Albums & Photos)

You retain ownership of your photos.
By uploading, you grant Sharepix a worldwide, royalty-free license to store, display, and share as needed to provide the service.
You represent that you have permission to upload any Content.

5. Acceptable Use & Prohibited Conduct

You agree not to use Sharepix for:

Uploading unlawful, offensive, or infringing Content
Harassment, spamming, or interfering with others' use
Automated scraping or excessive usage

We reserve the right to suspend or remove your access if you violate these terms.

6. Payment, Plans & Refunds

Sharepix offers limited free functionality. Premium upgrades are optional.
Paid plans auto-renew monthly or yearly.
Users may cancel anytime; refunds are determined at our discretion.
We may change pricing and plan terms at any time, with notice.

7. Termination

You may delete your account and Content at any time.
We may suspend or terminate access for violations or inactivity.
Upon termination, your Content may be deleted after a retention period.

8. Disclaimers & Limitation of Liability

USE AT OWN RISK. Sharepix is provided "AS IS," without warranties.
We disclaim merchantability, fitness for purpose, non-infringement, and uninterrupted service warranties.
In no event will Sharepix or its affiliates be liable for lost profits, data loss, indirect or special damages—even if warned of possibility.

9. Intellectual Property

All trademarks, logos, and rights in the App and brand belong to Sharepix.
You may not use our intellectual property without written permission.
You retain intellectual property rights over your uploaded Content.

10. Privacy & Data Protection

Your use of personal data is governed by our Privacy Policy. We comply with applicable privacy laws, including the GDPR, CCPA, and others in the US and EU.

For EU users:

You have rights to access, correct, delete, or restrict your data.
We process on lawful bases such as consent, contract performance, or legitimate interest.

11. Dispute Resolution & Governing Law

Unless local law requires otherwise, disputes are governed by the laws of California.
You and Sharepix agree to informal negotiation, followed by binding arbitration (or small claims court) unless prohibited by law.
Users in the EU may opt for local consumer dispute mechanisms.

12. Changes to Terms

We may revise these Terms at any time; significant changes will be communicated.
Your continued use after changes constitutes agreement to updated terms.
